Celebrating 5 Years of Birth Justice Law Firm

Celebrating 5 Years of Birth Justice Law Firm Years of Advocacy Anniversary 2021-2026

Five Years, One Mission: Justice for Mothers, Babies, and Families

Five years ago, Birth Justice Law Firm opened in Royal Oak with one purpose: to stand with mothers, babies, and families harmd by medical mistakes.

Birth should be one of the most joyful days of a family's life. When a preventable mistake leaves a baby with a brain injury, or a mother doesn't come home, that family deserves answers, accountability, and the resources to care for the people they love.

That is why we exist. As we mark this milestone, we want to look back at what these five years have meant, thank the people who made them possible, and look ahead to the work still in front of us.

Why we started

Birth Justice Law Firm was built by lawyers who know firsthand what it means to care for someone with a disability. Emily Thomas became an attorney because of her mother's disability, which shaped her high school years. Dan Kosmowski left a career in automotive engineering for the law, and for a decade he has been the caregiver for his father, who lives with a rare early-onset dementia.

We have sat on the other side of the desk. We know how daunting it is to call a lawyer and ask for help, and we know a family's needs don't end when the hospital stay does. We wanted to be the lawyers that we would want our family to have when encountering the most difficult and challenging situations of fighting for loved ones. We wanted to be lawyers that cared about our client’s families as much as our own.

Our focus has stayed the same since day one: securing lifetime care for children and families harmed by medical negligence. That means the therapy, equipment, accessible homes and vehicles, and skilled caregivers that make a full life possible.

Five years in the work

Most of what we do happens out of sight. It is reading thousands of pages of medical records, finding experts willing to tell the truth about what went wrong, and preparing every case as if it is going to trial. Since opening our doors, we’ve obtained millions of dollars for the families we represent.

What matters is what those recoveries make possible. Families we represent have used them for wheelchair-accessible homes and vans, therapy that insurance won't cover, and skilled caregivers who let a child stay at home.

A few moments we're proud of along the way:

•         December 2021: Emily joined the Justice Counts podcast to talk about representing mothers and babies harmed by medical malpractice at birth. Listen here.

•         December 2023: One of our cases was featured in The Wall Street Journal's reporting on how unprepared many emergency rooms are to treat children. Read more.

•         April 2024: Emily received the Board Legacy & Impact Award from the State Bar of Michigan Negligence Law Section. Read more.

•         November 2024: We called on Michigan lawmakers to support HB 6085 and restore justice for victims of medical malpractice. Read more.

•         November 2025: Emily’s featured article on deposition of defense experts published in the American Association for Justice Trial Magazine.

Our perfect 5.0 star Google reviews reflect our focus on our clients and even potential clients. No matter whether we can help your family, we promise to explain to you the applicable medical malpractice law and your rights.

What five years have taught us

Every family deserves to be heard in full. The first call is often the hardest one a parent makes. We listen to the whole story, and if we can't help, we tell families why.

The records don't always tell the whole truth. Charts written after an injury can leave out what really happened. That is why we read every page and bring in experts, often from outside Michigan, who will speak honestly about the standard of care.

A case is about a whole life, not a single day. A life care plan maps the therapy, equipment, housing, and care a child will need for decades. Our job is to make sure that plan is funded.

It takes a village. Raising any child takes help, and a child with special needs needs a bigger village. We see ourselves as one part of that village, alongside the doctors, therapists, caregivers, and trustees who carry families forward.

The next five years

The work ahead looks a lot like the work behind us: one family at a time, one case at a time, being prepared for trial.  We seek to grow our firm, better our community and to continue to obtain victories for families who fight everyday for their loved ones.

We will also keep pressing for change in Lansing. Michigan still caps what families can recover for the human losses caused by medical malpractice, and a death caused by malpractice does not, on its own, qualify for the higher cap. Families who lose a mother or a baby deserve better, and we will keep saying so.

Thank you

To the families who trusted us with the hardest chapter of their lives: thank you. Your courage is the reason this firm exists.

Thank you as well to the experts, co-counsel, life care planners, trustees, caregivers, and advocates who stand beside these families. And thank you to our own team, including Dan Kosmowski and Sara Lampinen, for showing up every day for people who need it.

If you have questions about the care you or your child received, we're here. Call us at (313) 230-5115 or tell us your story. Consultations are free, and no fee is due unless we recover money for your family.
